Documents and Information Required for the Application for Patent and Appearance Design Patent

A. ocuments Required for the Application Invention and Practical New Pattern

1. Specification: It is required to provide clear and complete specification for the invention and new pattern, and meet the standards that the common technicians of the technical fields can realize the application;
2. Rights Claiming Letter: It should be based on the specification and explain the patent protection scope;
3. Summary of the Specification: It is required to briefly explain the key technical points of the invention;
4. Figures Attached to the Specification (if any): The application of figures to additionally describe the text part of the Specification may directly and vividly demonstrate each item of technical characteristics and overall technical schemes of the invention.
5. Summary of the Attached Figure (if any): It is required to provide a figure that can to the greatest extent demonstrate the invention;
6. If you want to claim the prior rights, then it is required to provide the priority duplicate copy of the prior rights. If the invention to be applied for application of patents involves new microorganism and its products, and such microorganism is unavailable to the general public, then it is required to handle the microorganism fungi conservation procedures on or on later than the date of application. For the application for new practical pattern, it should be those new and practical technical schemes for the products shape, restructure or the integration. An invention or creation in relation to a type of method or production techniques cannot be awarded the new pattern patent.

B. Documents Required for the Related Appearance Design Patent

1. The photo or picture of the appearance design (in quadruplicate);
2. Specifying the name of product and the category that deploys the appearance design patent;
3. A photo or picture refers to the hexagonal positive projection view and relief effect view of the product applying the appearance design patent; if the view is symmetric, then one view figure can be omitted;
4. Please briefly demonstrate the main creation part, whether the color is protected or whether the view figure is omitted;
5. It is required to protect the color appearance design; and it is better to simultaneously present two sets of color and black-and-white picture or photo respectively;
6. If you want to claim for prior rights, then you should provide the priority level documents.

C. Materials to be Submitted for Application

1. It is required to specify the type of patent in application (invention, new practical pattern or appearance design);
2. Name, address and nationality of the applicant (the applicant can be natural person, enterprise or other legal persons);
3. Name, address and nationality of the inventor (the inventor or the designer should be natural person);
4. If you claim for prior rights, then it is required to provide the prior rights application country, date and number;
5. Other requirements for the application raised by the applicant.

D. The Signature of Entrusting Letter

The entrusting letter should be signed and sealed by the applicants (individual or enterprise of legal person)
